How long can I take partially paid parental leave?
The duration of the partially paid parental leave has not been changed in the new Collective Labour Agreement and remains 13 times your weekly working hours, i.e. 13 working weeks.
What is my salary during partially paid parental leave?
The Collective Labour Agreement stipulates ‘salary remuneration’, i.e. a percentage of your salary plus any allowances. As of 1 August 2022, the percentage of remuneration for parental leave during the child’s first year of life will increase from 62.5% to 70%.
For adopted and foster children, ‘first year of life’ should be taken to mean the first year following the date the child was adopted or taken into foster care.
You are entitled to 70% of your salary during the child’s first year of life.
UWV pays the employer 70% of the maximum daily wage during the child’s first year of life. The employer pays the employee 70% of their salary during the child’s first year of life. If the employee earns more than the maximum daily wage, this will not affect the amount of remuneration, which will remain at 70% of the salary.
You are entitled to 62.5% of your salary for parental leave after the child’s first year of life.
Does the new partially paid parental leave scheme also apply retroactively?
No, the effective date is 1 August 2022.
What happens to my current parental leave if my child is younger than one year old on 1 August 2022?
For currently active partially paid parental leave, the percentage of remuneration during the child’s first year of life will be increased from 62.5% to 70%.
The percentage of remuneration for partially paid parental leave after the first year of life remains at 62.5%.
Do I have to apply for leave at UWV?
No, you can submit your request for partially paid parental leave to VU Amsterdam.
I have already applied for parental leave which will start after 1 August 2022. Do I have to do anything else?
No, VU Amsterdam will implement the regulations of the new act and the provisions of the Collective Labour Agreement.
As of 1 August 2022, the Collective Labour Agreement stipulates that employees are entitled to 70% of their salary during the child’s first year of life and 62.5% thereafter up to 13 times the weekly working hours.
What happens when my child turns one during my current partially paid parental leave?
The percentage of remuneration will decrease from 70% to 62.5% when the child reaches the age of one.
I want to take partially paid parental leave for more than nine weeks. Do I have to submit two separate requests for leave?
No, you submit one request for parental leave to VU Amsterdam. Your request must include the following information:
- the child’s date of birth
- the starting date from which you wish to take leave
- the number of weeks of leave
- the number of hours of leave per week
VU Amsterdam will process your request and ensure you receive the remuneration you are entitled to.
Does a repayment scheme apply if I quit my job within six months after my parental leave ends?
No, the repayment scheme in the Collective Labour Agreement expires as of 1 August 2022.
I have become ill or totally incapacitated for work during my leave. Will my leave be suspended?
No. In principle, if you become ill or incapacitated for work during your parental leave, the leave you agreed with your manager will continue uninterrupted. If unforeseen circumstances apply as meant in the Collective Labour Agreement, you can submit a request to your manager to suspend the leave.
If the leave is for pregnancy, maternity or adoption, the parental leave will be suspended at the request of the employee.
I took parental leave when I worked for my previous employer. Am I still entitled to the remaining leave at VU Amsterdam?
Yes, you are entitled to 26 weeks of leave in total. So any leave you did not take at your previous employer can be taken at VU Amsterdam. This also applies to partially paid parental leave. If you did not take any paid parental leave when you worked for your previous employer, you can still take up to 13 weeks of paid leave at VU Amsterdam.
If you only took the statutory part of the paid parental leave when you worked for your previous employer (nine working weeks in total), you can still take the remaining four working weeks as paid parental leave at VU Amsterdam. The conditions are that you do not exceed 26 weeks in total and your child has not yet reached the age of eight years.
To apply for the leave at VU Amsterdam, you will need a statement from your previous employer which describes which paid and/or unpaid leave you have already taken.
I have been employed at VU Amsterdam for less than a year. Can I still request leave under this scheme?
Yes, you can. The condition that employees are only entitled to partially paid parental leave after one year of employment has been removed from the new Collective Labour Agreement, effective as of 1 August 2022. As of 1 August 2022, employees who have been employed for less than a year can also request partially paid parental leave.
What happens to the remaining (partially paid) parental leave if I leave the employment of VU Amsterdam?
If you change employers, you can reapply for leave to your new employer. The unused weeks will not be lost (provided you meet the conditions). Your new employer can reapply for leave for you. You can ask VU Amsterdam to provide a statement of which paid and/or unpaid leave you have already taken.
Please note: by law, you are only entitled to partial payment of your salary if the leave (maximum of nine working weeks) is taken during the child’s first year of life. If your new employer does not have an additional leave scheme and the child is older than one, you will not be entitled to partial payment of your salary for the remaining leave.
Am I entitled to (partially paid) parental leave for all of my children?
Yes, you are entitled to leave for all your children, including in case of multiple births or adoptions. However, you are only entitled to leave for one foster child.
